These Terms of Use ("Terms") govern your use of our website, www.msquaredmedical.co.za (the "Site"), and any services provided through the Site (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or Services.
You may use the Services only if you can form a binding contract with M-Squared Medical, are not legally prohibited from using the Services, and are complying with these Terms and all applicable law. Any use or access by anyone under the age of 18 is not permitted. Creating an account or using the Services does not give you ownership of any intellectual property rights in our Services or the content you may access. You may not use content from the Services unless you obtain permission from its owner or are otherwise permitted by law.
When placing an order for medical equipment or services, you represent that you are authorized to make the purchase and that all information provided is accurate. All sales are final unless otherwise specified. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud. Payment must be made in full at the time of order, and title to goods passes upon delivery.
For medical equipment purchases, you acknowledge that you are responsible for obtaining all necessary licenses, registrations, and certifications required by South African health regulations, including those from the South African Health Products Regulatory Authority (SAHPRA).
Shipping times are estimates and may vary due to factors beyond our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier. You are responsible for providing accurate shipping information. International shipments may incur additional customs duties and taxes, which are your responsibility.
Due to the nature of medical equipment, all sales are final, and returns are generally not accepted unless the product is defective or damaged upon arrival. Defective products must be reported within 7 days of delivery. Refunds, if approved, will be processed within 30 days. Shipping costs are non-refundable.
All content on the Site, including text, graphics, logos, and images, is the property of M-Squared Medical or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
You are responsible for any content you submit, including reviews or training registrations. By submitting content, you grant us a worldwide, royalty-free license to use it. You agree not to post content that is unlawful, defamatory, or infringes third-party rights.
To the fullest extent permitted by law, M-Squared Medical shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability shall not exceed the amount you paid us in the past 12 months.
We do not provide medical advice, and all equipment is sold "as is." It is your responsibility to ensure the equipment meets your clinical needs and regulatory requirements.
You agree to indemnify and hold harmless M-Squared Medical from any claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Gauteng Province.
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance. We will notify you of material changes via email or on the Site.
